Welcome to Bearmatchtees. These Terms & Conditions (“Terms”, “Legal Terms”) form a binding agreement between you and Brian Armando Palacios Gonzalez d/b/a Bearmatchtees (“Company,” “we,” “us,” or “our”) governing your access to and use of our website, products, and related services (collectively, the “Services”).

By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Services.

2. Updates to these Terms

We may modify these Terms from time to time. When we do, we will update the “Last Updated” date above. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms. We recommend you keep a printed copy for your records.

3. Our Services

Our site offers made-to-order products and related customer support. The Services are not intended for use in any jurisdiction where such use would be illegal or would subject us to registration requirements. If you access the Services from outside permitted locations, you do so at your own initiative and are responsible for compliance with local laws.

Shipping scope & timelines. As detailed in our Shipping Policy, we currently ship within the continental United States only. Typical timelines are estimates and not guaranteed once a parcel is with the carrier. Order cut-off is 5:00 PM (Eastern Time) on business days; orders placed after that time are processed the next business day. Delivery time = Handling Time + Transit Time.

4. Account & eligibility

By using the Services you represent that you (i) have legal capacity to enter into these Terms, (ii) are not a minor in your jurisdiction, (iii) will not use automated means to access the Services, and (iv) will comply with applicable laws.

If information you provide is untrue or incomplete, we may suspend or terminate your access.

5. Intellectual property

All content within the Services—including text, graphics, logos, product designs, photos, audio/video, software, databases, and the overall look and feel (collectively, “Content”)—and all trademarks and service marks (“Marks”) are owned by or licensed to Bearmatchtees and are protected by intellectual-property and unfair-competition laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access the Services and to download/print portions of the Content solely for your personal, non-commercial use. No other rights are granted. Any use, reproduction, distribution, display, or creation of derivative works without prior written consent is prohibited.

6. Your submissions & feedback

If you send us questions, suggestions, designs, ideas, or other materials (“Submissions”), you assign to us all intellectual-property rights in such Submissions and authorize us to use them for any lawful purpose, without compensation. You warrant that you have the rights necessary to provide any Submission, and that it does not include confidential information or infringe third-party rights.

7. Prohibited activities

You agree not to:

• Scrape, harvest, or compile the Services’ data without written permission;
• Circumvent security or access controls;
• Upload malicious code, unsolicited promotions, or content that is unlawful, defamatory, obscene, harassing, discriminatory, or misleading;
• Impersonate any person or misrepresent your affiliation;
• Reverse engineer or attempt to extract source code (except as permitted by law);
• Use automated tools (bots, spiders, scrapers) except standard search-engine or browser usage;
• Use the Services to compete with us or for any unauthorized commercial purpose.

8. Store policies (part of these Terms)

The following policies are incorporated by reference and apply to your orders. They are designed to work together and use the same business details (company name, address, support hours, and contact information):

• Shipping Policy – carriers (USPS/DHL/EMS/local), continental U.S. only, 5:00 PM ET cut-off, handling & transit windows, tracking, and address-accuracy requirements.
• Return Policy – returns of non-sale items within 180 days of delivery; items must be unworn, unwashed, with tags, and accompanied by proof of purchase. Return Cost: $0.00 for approved defective/incorrect items; otherwise customer may bear return shipping.
• Refund Policy – order cancellations within 24 hours at no charge; after 24 hours orders are made-to-order and cannot be canceled. Refunds typically processed within 2 business days after receipt and inspection; bank processing may add 5–10 business days. Eligibility rules and documentation requirements apply.
• Cookie Policy – explains our use of cookies/trackers and your choices.

In the event of a conflict between this page and the individual policy pages regarding shipping windows, cancellations, or returns, the most recent policy page will control for that specific subject matter.

9. Pricing, availability & errors

We strive to ensure accuracy, but errors or omissions may occur (e.g., product descriptions, pricing, availability). We reserve the right to correct errors and to change or update information at any time without notice. If an error affects your order, we may contact you to confirm, cancel, or adjust the order and issue any applicable refund.

10. Address accuracy & delivery

You are responsible for providing a complete and accurate shipping address. We are not responsible for deliveries to an address you supplied incorrectly, for returned packages due to incomplete addresses, or for loss after you request a carrier redirect. Re-shipping fees may apply to reship returned items.

11. Production, cancellations & exchanges

Orders begin processing once payment is accepted. Because our products are made to order, post-production changes are limited. Per our Refund Policy, you may cancel within 24 hours of purchase without charge; after that, orders cannot be canceled or modified. Exchanges are handled per our Return/Refund Policies.

12. Services management

We may monitor the Services for compliance, remove or disable content, restrict access, or take legal action for violations. We may also remove files/content that are excessive in size or burdensome to our systems.

13. Availability; modifications & interruptions

We do not guarantee that the Services will be available at all times. Maintenance, technical issues, or events beyond our control may cause interruptions. We may modify, suspend, or discontinue the Services (or features) at any time without notice. We are not liable for loss or inconvenience caused by downtime.

14. Privacy & cookies

Your use of the Services is also governed by our Cookie Policy and any posted privacy disclosures. By using the Services, you consent to our handling of information as described there.

15. Disclaimer of warranties

THE SERVICES AND ALL CONTENT/PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted or error-free operation, that defects will be corrected, or the accuracy or completeness of content.

16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BEARMATCHTEES OR ITS OWNERS, EMPLOYEES, OR AGENTS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION), EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO BEARMATCHTEES FOR THE PRODUCT(S) OR SERVICE(S) AT ISSUE.

Some jurisdictions do not allow certain limitations; in those places, our liability will be limited to the maximum extent permitted by law.

17. Indemnification

You agree to defend, indemnify, and hold harmless Bearmatchtees and its affiliates, officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (i) your use of the Services or products; (ii) your breach of these Terms; (iii) your violation of any third-party rights (including IP); or (iv) any harmful act toward another user.

18. Governing law; venue

These Terms are governed by the laws of the State of California and applicable U.S. federal law, without regard to conflict-of-law principles. Subject to the Arbitration clause below, the exclusive venue for disputes that are not arbitrated will be the state or federal courts located in Stanislaus County, California, and you consent to personal jurisdiction there.

19. Dispute resolution & arbitration

Informal resolution first (180 days). To reduce costs, the parties will attempt to resolve any dispute, claim, or controversy relating to these Terms or the Services (“Dispute”) through good-faith negotiations for 180 days after written notice.

Binding arbitration. If not resolved, Disputes shall be finally resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules (or Consumer Rules, if applicable).

Restrictions. Arbitration is on an individual basis only: no class actions, consolidated claims, or representative proceedings.

Exceptions. Either party may: (i) bring an action in a court of competent jurisdiction for injunctive relief (e.g., IP protection), or (ii) pursue claims in small-claims court if eligible.

20. Electronic communications; signatures

By visiting the site, emailing us, or completing online forms, you are communicating electronically and consent to receive electronic communications from us. You agree that electronic signatures, contracts, orders, and records satisfy any legal requirements for written documents.

21. Data retention

We maintain certain data transmitted to or generated by the Services for performance and recordkeeping. While we take reasonable backups, you are responsible for your own data. We are not liable for any loss or corruption of such data.

22. Miscellaneous

These Terms, together with the policies referenced herein, constitute the entire agreement between you and us. If any provision is found unenforceable, the remainder will continue in full force. No waiver of any term is a waiver of future breaches. We may assign these Terms at any time. No agency, partnership, joint venture, or employment relationship is created by your use of the Services. These Terms will not be construed against the drafter.
